Landlord Tenant Disputes

From my Orange County law office, I represent either landlords or tenants that are involved in landlord tenant disputes. As an experienced eviction attorney, I provide legal representation in a wide variety of landlord / tenant disputes including evictions and constructive evictions, rental disputes, and leases. A common matter that causes many problems is a lease violation that leads to the filing of Unlawful Detainer. An Unlawful Detainer is the act of wrongfully remaining in possession of property (for example, after the expiration of a lease). An Unlawful Detainer Action is the action taken by the landlord or property owner that is intended to restore the possession of a property to its owner.

Tenants should avoid Unlawful Detainers if at all possible, because they can make it difficult to obtain future leases from other landlords, and often lead to homelessness. The best way to avoid Unlawful Detainers is to stay within the rules of the lease in terms of noise, number of occupants, and timely payment of the rent. If a landlord has not made repairs that were promised, withholding rent is not a good option, because it can lead to a UD. There are other legal remedies available to tenants, rather than withholding rent payments. Tenants should be aware that a landlord does not need a reason to ask you to leave, as long as proper notice (30 days is typical) is given.

Landlords can use Unlawful Detainers to evict those in serious violation of the terms of the lease. A UD is often used to evict drug dealers, those who have overnight guests coming and going, and those who are behind on their rent. As a lawyer experienced in all areas of eviction law, I will advise my landlord clients whether or not a lawsuit has merit.
